Market conduct has become a central focus of financial regulation, both globally and in South Africa, as regulators aim to ensure fair customer outcomes, transparency, and ethical behaviour across financial markets. The evolving regulatory landscape, together with increasing market complexity and innovation, continues to shape how financial institutions operate and manage conduct risk.
This workshop will provide an overview of market conduct within an international and South African context, including key definitions, the structure of the financial sector, and applicable regulatory frameworks. It will examine the South African Twin Peaks model, key legislation such as the Financial Sector Regulation Act, Financial Markets Act, FAIS, FICA and POPIA, as well as upcoming regulatory developments.
The workshop will also explore governance considerations, including King IV and King V, and provide insight into market conduct risk management frameworks, covering risk culture, strategy and processes. In addition, it will consider emerging developments such as financial technology, cyber security, crypto assets and other innovations impacting market conduct.
Throughout the workshop, practical examples and case studies will be used to reinforce key concepts.
