Demystifying Debarment: Debarment Procedures and Pitfalls in Financial Services

What is it about?

This workshop is aimed at anyone in an FSP role who wishes to understand the legislative procedures around debarment under the FAIS and FSR Acts. This workshop will cover in detail the regulations FSPs and key individuals need to know and follow when debarring a person. We will look at case law from the courts and the Financial Services Tribunal to see where FSPs have gone wrong and highlight how labour law principles and unfair labour practices intersect with FAIS. This workshop will explore some practical exercises dealing with debarment and disciplinary procedures. Finally, we will explore the implications of COFI on debarment.

Paul is the founder of Lightbulb Learning and Training, which specialises in providing training for financial planners for formal qualifications, regulatory examinations, professional competence and the FPI Board Exams. In 2007, Paul was awarded the prize for top Advanced Post-graduate student in the country for both modules. He is the managing editor of the SA Financial Planning Handbook, SA Financial Planning Case Studies, Fundamentals of Financial Planning, Legislation Handbook and Preparatory Guide for RE 1 & RE 5, all published by LexisNexis. He is passionate about the education, transformation and professionalism of the financial planning industry. He has been a guest speaker at numerous events. Paul is also the founder of The Assembly Improv South Africa which provides facilitation in long-form improvisational comedy, team building and applied improv for developing financial planners’ communication skills. Paul has completed CFA level I and the Psychology of Financial Planning Specialist™ course. He is a Fellow of the South African Institute of Financial Markets and serves as a Governor on the SAIFM board.

CPD

CPD for FAIS purposes
This workshop provides verifiable CPD points in terms of the Determination of Fit and Proper Requirements for Financial Services Providers, BN 194 of 2017, provided that the content is appropriate for your role within the company. A certificate of attendance will be issued that could be submitted to your company’s compliance officer. The number of verifiable CPD hours will be up to 3 hours.

CPD for SAIFM members’ purposes
This workshop provides verifiable CPD points in terms of the CPD policy of SAIFM provided that the content is appropriate for your current or future role within the company. A certificate of attendance will be issued, which should be retained and submitted should you be selected for a SAIFM member CPD audit. The number of verifiable CPD hours will be up to 3 hours.
